These Terms of Service govern your use of BrixFit, a product of Brixfly Services ("we", "us", "our"), registered in India. By using BrixFit, you agree to these Terms.

1. Who Can Use BrixFit

By creating an account, you confirm that:

• You are at least 18 years old
• The information you provide is accurate and complete
• You are using BrixFit for lawful purposes only

If you are signing up on behalf of a business, you confirm you have authority to do so.

2. What BrixFit Does

BrixFit is an AI-powered platform for fitness coaches. It lets you:

• Manage clients, leads, check-ins, and health data
• Create and assign workout and diet plans
• Generate AI health reports and lead analysis
• Share a white-label coaching portal with your clients — on a custom subdomain (Growth) or your own domain, e.g. portal.yourdomain.com (Pro)
• Track progress, photos, and body metrics
• Communicate with clients via in-app messaging
• Send automated notifications via WhatsApp (Growth and Pro plans)
• Track client meal compliance and nutrition logging

3. Your Account

• You are responsible for all activity on your account
• Keep your password secure — do not share it
• Notify us immediately at [email protected] if you suspect unauthorised access
• You may not create multiple free accounts

4. Subscriptions & Billing

4.1 Plans

BrixFit offers subscription plans with different feature limits (clients, AI reports, etc.). Plan details are always available at brixfit.app/pricing.

4.2 Billing

• Subscriptions are billed in advance — monthly or annually
• Prices are shown in INR or USD depending on your account
• We may update pricing with 30 days' notice to your registered email

4.3 AI Usage Limits

Features like health reports and lead analysis use AI credits. These credits:

• Are allocated per billing cycle based on your plan
• Do not carry forward to the next cycle — they reset on your renewal date
• Cannot be transferred or exchanged

4.4 Taxes

Prices may not include applicable taxes. GST is added at checkout for Indian customers where required by law. Your GST invoice is available in your billing dashboard.

4.5 Upgrading & Downgrading

You can change your plan from your billing dashboard, subject to the following rules:

• All plan changes (upgrades and downgrades) are scheduled to take effect at the end of your current billing cycle. Your current plan remains active until the billing period ends, and your new plan starts at the next renewal.
• Upgrades can be requested at any point during your billing cycle.
• Downgrades can only be requested during the last 7 days of your current billing cycle. Outside this window, the downgrade option is unavailable.
• If you are downgrading to a plan with a lower client limit, you must archive excess active clients before the downgrade can be confirmed.
• No mid-cycle charges, credits, or refunds are issued for any plan change. There is no proration. See our Refund Policy for full details.

4.6 Refunds

All subscription fees are non-refundable. Please read our Refund Policy for the full details, including the limited exceptions for billing errors.

5. What You Must Not Do

You agree not to:

• Use BrixFit for any illegal activity
• Provide false health information about clients
• Attempt to copy, reverse-engineer, or resell the BrixFit platform
• Use bots, scrapers, or automated tools against our systems
• Circumvent plan limits through any technical means
• Impersonate another person or business

Violating these rules may result in immediate account suspension without refund.

6. Your Data

• Your data belongs to you. You own all client data, plans, and content you create on BrixFit.
• We store and process your data only to provide the service.
• We do not claim ownership over anything you create on BrixFit.

7. Health Disclaimer & Metric Methodology

7.1 Nature of Health Content

AI-generated health reports on BrixFit are for informational and wellness guidance purposes only. They are not medical advice, clinical diagnosis, or treatment recommendations and should not replace professional medical consultation. As a coach, you are responsible for how you use and communicate this information to your clients.

7.2 Health Metric Calculations

BrixFit calculates health metrics using internationally validated clinical formulas:

7.3 Accuracy & Estimates

• All displayed metrics are estimates based on the measurements and information provided by the user.
• The ~ symbol on any metric indicates a calculated estimate. Individual values can vary by approximately ±5–15% depending on body composition, health conditions, and measurement accuracy.
• BMI does not distinguish between muscle mass, bone density, and fat. It is a population-level screening tool, not a diagnostic measure.
• Body fat percentage is estimated from BMI and age using the Deurenberg formula (standard error ±3–5 percentage points). Direct clinical measurements provide higher individual accuracy.
• BMR and TDEE carry an approximate ±10% individual variance inherent to the Mifflin-St Jeor formula.

All calculations follow:

• WHO Obesity & Overweight Guidelines
• ICMR-NIN Dietary Guidelines for Indians 2024
• National Health Portal (Government of India) BMI classifications
• Ministry of Health & Family Welfare nutrition standards

7.5 No Medical Advice

Metrics displayed on BrixFit are intended to support, not replace, the guidance of a qualified healthcare professional. For clinical diagnosis, treatment planning, or health conditions, users must consult a registered medical practitioner or dietitian.

8. Our Intellectual Property

The BrixFit platform, name, logo, and all underlying technology are owned by Brixfly Services. You may not copy, redistribute, or build upon any part of our platform without our written permission.

9. No Guarantees

BrixFit is provided as-is. We do our best to keep the platform fast, accurate, and available — but we cannot guarantee it will always be uninterrupted or error-free.

10. Our Liability

To the extent permitted by Indian law, Brixfly Services is not liable for:

• Any indirect or consequential loss arising from your use of BrixFit
• Loss of clients, revenue, or business opportunities
• Any amount exceeding the total fees you paid in the 3 months before the issue arose

11. Account Termination

We may suspend or terminate your account if:

• You violate these Terms
• You have outstanding unpaid fees
• We are required to do so by law

If your account is terminated, access to the service ends immediately. Your data handling after termination is described in our Privacy Policy.

You may delete your own account at any time from your dashboard.

12. Changes to These Terms

We may update these Terms from time to time. We will notify you by email or an in-app notice before material changes take effect. Continued use of BrixFit after that constitutes acceptance of the updated Terms.

13. Governing Law

These Terms are governed by the laws of India. Any disputes shall be resolved in the courts of Rajasthan, India.
